Please read these Terms of Use ("Terms") carefully before accessing or using Kryptov (the "Service"). By accessing or using any part of the Service you ("User," "you" or "your") agree to be legally bound by these Terms. If you do not agree to all of the Terms, you must not access or use the Service.

1. Definitions

"Kryptov," "we," "us," and "our" mean the operator(s) of the Service, together with all parents, subsidiaries, affiliates, successors, and assigns.

"Content" means all text, graphics, data, software, audio, video, information, and other materials available on or through the Service.

"User Contribution" means any Content that a User submits, posts, publishes, displays, or otherwise makes available on or through the Service.

"Trading Services" means the portion of the Service that enables Users to manage cryptocurrency trading activities, alerts, automation, and related features through integration with cryptocurrency exchanges.

2. Changes to Terms & Service

We may revise these Terms —and may change, suspend, or discontinue any part of the Service—at any time in our sole discretion. If we make material changes, we will post the revised Terms and provide at least thirty (30) days' notice before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

3. Eligibility & Compliance

You represent that you (a) are at least 18 years old and legally capable of entering into contracts; (b) have not been previously suspended or removed from the Service; (c) comply with all applicable laws and regulations regarding cryptocurrency trading in your jurisdiction; and (d) will comply with all applicable laws, regulations, and third‑party terms (including exchange policies) when using the Service.

4. License & Intellectual Property

4.1 Ownership

The Service and all Content (except User Contributions) are owned by Kryptov or its licensors and are protected by intellectual‑property laws.

4.2 Limited License

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your internal purposes. No other rights are granted.

4.3 Trademarks

Kryptov and related marks are our proprietary trademarks. You may not use any trademarks without our prior written consent.

5. User Contributions & API Security

5.1 Responsibility

You retain ownership of, and are solely responsible for, your User Contributions and API credentials.

5.2 API Key Security

You are solely responsible for the security and proper configuration of your exchange API keys. You must ensure that API keys have appropriate permissions and are kept secure. We recommend using API keys with trading permissions only and never sharing API keys with withdraw permissions.

5.3 License to Kryptov

By submitting any User Contribution, you grant us a worldwide, royalty‑free, perpetual, irrevocable, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works from, publish, display, and distribute that User Contribution in connection with operating and improving the Service.

5.4 Prohibited Content

You will not upload, post, or transmit any Content that: (a) infringes any third‑party right; (b) is unlawful, defamatory, obscene, harassing, or otherwise objectionable; (c) violates any exchange guidelines; or (d) contains viruses or other harmful code.

6. Acceptable Use & Prohibited Conduct

You agree not to:

Use the Service for any illegal, deceptive, or fraudulent purpose.
Interfere with, disrupt, or impair the functioning of the Service.
Copy, scrape, harvest, or index any Content without authorization.
Attempt to gain unauthorized access to any accounts, systems, or networks.
Use automated means (including bots or scripts) to access the Service except through documented APIs we expressly make available.
Use the Service for market manipulation, pump and dump schemes, or other fraudulent trading activities.

7. Trading Services & Risk Disclaimers

7.1 No Financial Advice

IMPORTANT: Kryptov does not provide financial advice, investment recommendations, or trading guidance. All features, alerts, and automation tools are for informational and convenience purposes only. You must conduct your own research (DYOR) and make independent decisions about your trading activities.

7.2 Cryptocurrency Trading Risks

WARNING: Cryptocurrency trading involves substantial risk of loss and is not suitable for all investors. Cryptocurrency markets are highly volatile and unpredictable. Past performance does not guarantee future results. You may lose some or all of your invested capital. Only trade with money you can afford to lose.

7.3 Automated Trading Risks

Our automated trading features execute trades based on predetermined algorithms and signals. You acknowledge that: (a) automated trading can result in rapid losses; (b) market conditions can change quickly making automated strategies ineffective; (c) technical failures may occur; (d) you are solely responsible for monitoring and stopping automated trading; and (e) past performance of automated strategies does not guarantee future performance.

7.4 Third-Party Exchanges

Our Service integrates with third-party cryptocurrency exchanges. We do not control these exchanges and are not responsible for their availability, security, policies, or any issues that may arise from your use of their services.

7.5 Regulatory Compliance

Cryptocurrency trading laws and regulations vary by jurisdiction and change frequently. You are solely responsible for ensuring your use of our Service and any trading activities comply with applicable laws and regulations in your jurisdiction.

8. Fees, Payment & Refunds

8.1 Fees

Prices for subscriptions are as listed on the Service and are subject to change at any time before purchase.

8.2 Payment Processor

Payments are processed by third‑party payment providers. We are not responsible for their acts or omissions.

8.3 Refund Policy

First‑time subscribers may request a full refund within seven (7) calendar days of the initial subscription payment by emailing [email protected]. Refunds are limited to one per customer and will be issued to the original payment method. After the 7‑day period, all sales are final and non‑refundable.

9. Modifications, Suspension & Termination

We may modify, suspend, or terminate the Service—or your access to it—at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the Service will automatically terminate, but Sections 4, 5, 7, 10–16 will survive.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Kryptov disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and results. Without limiting the foregoing, we make no warranty that:

The Service will be uninterrupted, timely, secure, or error‑free;
Any Content (including trading signals or automation) is accurate, reliable, or will result in profits;
The Service will improve trading performance, prevent losses, or generate profits;
Cryptocurrency markets or exchange policies will remain stable;
Automated trading strategies will be profitable or effective.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will Kryptov, its affiliates, licensors, or service providers be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any lost profits, lost revenue, lost data, business interruption, trading losses, or cost of substitute services, arising out of or in connection with the Service or these Terms—even if advised of the possibility of such damages. Our total cumulative liability for any claims relating to the Service will not exceed the amount you paid us, if any, for the Service in the twelve (12) months before the event giving rise to liability.

12. Indemnification

You will defend, indemnify, and hold harmless Kryptov and its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) your User Contributions; (c) your violation of these Terms or any laws; (d) your trading activities and decisions; or (e) your interactions with third‑party exchanges or services.

13. Governing Law & Venue

These Terms and any dispute arising from or related to them will be governed by and construed in accordance with the laws applicable in our principal place of business, without regard to its conflict‑of‑law principles. The courts located in that jurisdiction will have exclusive jurisdiction over all disputes not subject to arbitration.

14. Dispute Resolution & Arbitration

14.1 Informal Negotiations

Before commencing formal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.

14.2 Binding Arbitration

If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to the Service or these Terms shall be settled by binding arbitration administered by a recognized arbitration provider, under its rules then in effect. The arbitration will be conducted in English by a single arbitrator.

14.3 Class‑Action Waiver

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or class member in any purported class or representative proceeding.

15. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of that term or any other term.

16. Entire Agreement

These Terms constitute the entire agreement between you and Kryptov regarding the Service and supersede all prior or contemporaneous understandings. The headings are for convenience only and have no legal effect.
